Covert video surveillance by the employer neither permitted nor capable of proof

15.6.2011: Ein interessantes Urteil zum Thema Videoüberwachung hat das Arbeitsgericht Düsseldorf im Mai 2011 gefällt. Dabei ging es um zwei Mitarbeiter eines Ausschankes, die der Arbeitgeber pauschal im Verdacht hatte, ausgeschenkte Biere nicht korrekt abzurechnen. Daher ließ der Arbeitgeber den Schankraum heimlich per Video überwachen und kümdigte einem Mitarbeiter, der sofort Kündigungsschutzklage erhob. Der zweite war Betriebsrat – und hier wollte der Arbeitgeber die vom Betriebsrat nicht erteilte Zustimmung der Kündigung vor Gericht ersetzen lassen. In beiden Fällen scheiterte der Arbeitgeber. The Hessian state labor court for an employer to pay compensation of 7.000 € sentenced, because he was an employee at least since June 2008 at work constantly monitored by a video camera. The 24 – year-old clerks working in a Hessian branch of a nationwide company active. Opposite the entrance door of the office, the employer had installed a video camera, not only to the input range, but the focus was directed on the workplace of the applicant. Surveillance cameras and protective of individual rights

In US-Serien wie NCIS Los Angeles wird immer wieder geschaut, wo Überwachungskameras sind, diese werden angezapft, so kommt man dem Täter schnell auf die Spur. Class, denkt man, so kommen die Ermittlungen meist voran – doch was ist mit den Persönlichkeitsrechten? In Deutschland ist das Thema Überwachungskamera oder Videoüberwachung eher heikel, ganz im Gegensatz etwa zu den USA oder England, das wohl das dichteste Überwachungskameranetz der Welt hat.
